Booking conditions

1. OBJECT

  • In accordance with the booking request, it is hereby established that the tenant rents the vacation house, as described in the booking request, for the stay period specified in the booking module.
  • Each home has a maximum capacity, as described on www.tentweelinden.be and in the booking module. The landlord (or the authorized contact person) reserves the right to forbid access to the rented accommodation on arrival or to end the stay if the total number of attendees exceeds the capacity and/or the composition of the group does not match with the specified composition, without the tenant being able to claim any compensation.
  • The booked house and its division are described in detail on www.tentweelinden.be .
  • The tenant must be of legal age. Any reservation concluded by a person under the age of 18 is deemed to be non-existent, without the tenant being able to claim compensation from the landlord

2. ACCEPTANCE GOOD CONDITION OF THE VACATION HOUSE

  • The landlord offers the house in a good state of repair, safety, hygiene and habitability and in accordance with the applicable Belgian legislation.
  • In the event of complaints, the tenant must immediately report this to the person on site or to the landlord on the day of arrival at the vacation house and then do so in writing, after which an attempt will be made to settle the complaint in mutual consultation. If the complaint cannot be reported within 24 hours because the landlord cannot be reached and no person is present on site (contactless arrival), it must be reported to the landlord by registered letter within one week of arrival, in order to be admissible. are.
  • The tenant declares to comply with the agreement as well as the house agreements.
  • The landlord explicitly points out that certain doors of the house do not have the standard size, so that larger guests may bump into the door edge. The tenant and/or his/her fellow guests explicitly acknowledge to have taken note of this fact and exempt the landlord from any possible damage resulting from knocking at a door edge.

3. RENTAL PRICE, COSTS AND WARRANTY

  • The rental price, as stated in the booking module and on our website, is all-in. This includes made beds and towels per guest, the costs for gas, electricity, water as well as cleaning and collection of waste and is clearly described in your booking request.
  • Charging of electric car is possible via loading station and (own) card. 
  • The payment of an advance of 30% of the rent is required in order to make the reservation final. An advance invoice will be sent to you by email.
  • In the event of late payment of the advance payment, the lessor reserves the right to rent out the reserved vacation house to another party, without further formalities or notification, without prejudice to the right to cancellation compensation in accordance with Article 5.
  • The remaining amount (Rental price – advance), together with the warranty (EUR 500.00), will be invoiced six (6) weeks before the arrival date. This invoice will be automatically sent to you by email.
  • The warranty will be refunded to the tenant no later than 14 days after the end of the rental period. Possible damage to the vacation house or the internal movable property or any missing movable property and/or unforeseen standard cleaning costs (see bullet point 8 of Article 4)  will be deducted from the deposit.

4. ARRIVAL AND STAY

  • In case the vacation house is booked for a weekend, the tenant must arrive on Friday evening between 5 and 8 pm and vacate the house no later than Sunday evening at 6 pm.
  • In case the vacation house is booked for a midweek, the tenant must arrive on Monday between 5 and 8 pm and vacate the house no later than Friday morning at 10 am.
  • Parties can agree in writing other dates and times for arrival and departure.
  • The tenant and his/her co-tenants must occupy the vacation house with the required care and care. It is forbidden to move furniture without the permission of the landlord.
  • Unless otherwise agreed in writing, visitors and pets are not allowed.
  • The spaces are only intended for temporary occupancy and this without causing nuisance to neighbors (noises, smells, smoke, lights, etc.). After 10 pm, no noise is allowed outside (to respect the neighbors' nighttime sleep).
  • The tenant undertakes to treat the rented property and its contents with due care in all situations. The tenant undertakes to respect the house (this concerns, among other things, closing windows and doors in wind/rain, closing the house when absent, the reasonable use of water, gas, electricity and respecting the environment), as well as its surroundings including noise. In the event that the tenant's behavior leads or may lead to a nuisance or burden that jeopardizes or may jeopardize the smooth running of the stay, the landlord reserves the right to terminate the present contract, without prior notice and without compensation, To cancel.
  • It is also expressly prohibited to:
    • to sublet the vacation house
    • to smoke in the vacation house
    • barbecue inside the vacation house
    • camping on the domain (unless otherwise agreed with the landlord)
    • organize bachelor parties
  • At the end of the stay, the tenant must:
    • to collect all waste in the garbage bags/bins provided for that purpose
    • the used plates, glasses, cutlery, pots, pans…. clean and return them to their original position. When using the dishwasher, it must be unloaded before departure
    • leave all sanitary facilities tidy
    • empty fridge, freezer
    • close all windows and doors
    • turn off the heating (radiators in the rooms)
    • to leave the house broom clean.
  • At the end of the stay, the tenant and landlord can make a tour of the vacation house together, where possible comments about the condition of the house can be determined. These findings are not binding for the lessor: any damage that is subsequently determined may be deducted from the deposit amount.
  • If the house is not left swept clean, the landlord has the right to charge the tenant for the time it has to spend on cleaning the vacation house, at a rate of € 35.00 per hour. The aforementioned costs for cleaning the vacation house will be deducted from the deposit.

5. CANCELLATION

  • The tenant is entitled to cancel the rental at any time before the start of his/her stay, provided that the agreed cancellation fee is paid. Cancellations, for whatever reason, must be reported immediately by telephone to the landlord and subsequently confirmed in writing. The cancellation will be final upon receipt of the written confirmation.
  • The late payment of the advance or the late appearance at the appointment ('no-show') are equated with cancellation.
  • The cancellation fee is:
    • in case of cancellation between 0 and 7 days before arrival: 100 % of the full rental amount
    • in case of cancellation between 21 and 8 days before arrival: 50% of the full rent.
    • in case of cancellation between 21 and 60 days before arrival: 200.00 euros
    • in case of cancellation before 60 days before arrival: 50 euros (administration fee)
  • The balance (Rental price + deposit less the aforementioned cancellation fee) will be refunded no later than four weeks after the cancellation.

6. LIABILITY

  • The tenant must have public liability insurance that covers all damage to the vacation house, the garden, the swimming pond and the furniture/goods present.
  • The tenant, being the person who made the reservation, is liable for damage caused to the house, its contents, to third parties or to their goods, as a result of illegal conduct or of improper or abnormal use of the good or of its contents, of theft or fire, as well as of non-compliance with contractual obligations. The costs to which the landlord is exposed in order to restore the house to its former condition, taking into account an age coefficient if necessary, will be deducted from the deposit and recovered from the tenant by the landlord if the deposit is insufficient to cover the aforementioned costs. .
  • Any damage must be reported to the landlord as soon as possible.
  • The landlord is not liable for:
    • loss, theft, damage or injury, of whatever nature, caused to the tenant and his/her co-tenants
    • any disruption, change or impediment to the tenant's stay if this is the result of unforeseen or insurmountable events caused beyond his control, by the work of third parties or the government, interruptions in the supply of utility companies, etc.
  • The lessor can in no way be regarded as a travel organization or travel agent, the lessor's role is limited to renting out the vacation house.
  • The use by the tenant and/or his/her company of the garden, swimming pond and play equipment is at their own risk.

7. VISIT OF THE LANDLORD

The landlord (or an authorized contact person) is permitted, by means of an appointment with the tenant, to visit the property, with the aim of checking whether all obligations and agreements are correctly performed or for inspection or maintenance of the indoor installations and /or heating. This right must take into account the tenant's private life and must be exercised in moderation.

8. OTHER PROVISIONS

  • Changes, additions, etc. to this agreement can only be validly agreed in writing.
  • The invalidity or unenforceability of any provision of this Agreement shall not affect the validity or enforceability of the Agreement itself or any other provision thereof. The invalidity or unenforceability is limited to the invalid or unenforceable aspect of the provision in question. Any invalid provisions of this agreement will not give rise to annulment but will be moderated by the court to the maximum of what is legally permitted.
  • All possible disputes arising from or in connection with this agreement, or regarding its validity, interpretation or implementation, fall under the exclusive jurisdiction of the courts of the district of Leuven.
  • Belgian law applies.
